Terms of Use
These Terms of Use govern access to and use of AlphaPing-operated websites, interfaces, and related services (collectively, the “Interface”). By accessing or using the Interface, you agree to these Terms. If you do not agree, do not use the Interface.
Informational Purpose; No Advice
The Interface is provided for informational and operational purposes only. AlphaPing does not provide investment advice, legal advice, tax advice, or any recommendation. Nothing on the Interface constitutes an offer, solicitation, or recommendation to buy, sell, or hold any asset or to engage in any strategy.
Non-Custodial Use; User Responsibility
AlphaPing does not take custody of user assets. Users interact directly with third-party smart contracts using their own wallets. You are solely responsible for safeguarding private keys, verifying transaction details, and understanding approvals and permissions prior to submitting any transaction.
Third-Party Protocols; No Control
The Interface may facilitate interaction with third-party protocols, smart contracts, and networks. AlphaPing does not control such third parties and does not guarantee their security, correctness, availability, or economic outcomes. Protocol upgrades, parameter changes, governance decisions, or emergency actions may materially affect behavior and outcomes.
Assumption of Risk
Using digital assets and interacting with blockchain protocols involves significant risk, including the risk of partial or total loss. You acknowledge and accept all risks described in the Risk Disclosure and any protocol-specific documentation you choose to rely upon.
No Warranties
The Interface is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. AlphaPing disclaims all warranties, including merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.
Limitation of Liability
To the maximum extent permitted by applicable law, AlphaPing shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses, arising from or related to your access to or use of the Interface or any third-party protocol.
To the maximum extent permitted by applicable law, AlphaPing’s aggregate liability for any claim arising out of or relating to the Interface shall not exceed CHF 100, except to the extent liability cannot be excluded under mandatory law.
Indemnification
You agree to indemnify and hold harmless AlphaPing and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Interface, your violation of these Terms, or your violation of any rights of any third party.
Acceptable Use
You agree not to misuse the Interface. This includes, without limitation:
- attempting to interfere with, disrupt, or compromise the Interface or underlying systems;
- using the Interface to violate any law, regulation, or third-party rights;
- attempting to bypass access controls, rate limits, or security measures;
- submitting malicious code, exploiting vulnerabilities, or attempting unauthorized access.
Eligibility; Sanctions; Compliance
You represent that you are not located in, organized under the laws of, or ordinarily resident in any jurisdiction where your use of the Interface would be prohibited, and that you are not subject to sanctions or otherwise designated on any sanctions list. You are solely responsible for complying with applicable laws, regulations, sanctions, and tax obligations.
Intellectual Property
The Interface and its content, including text, layout, trademarks, and software, are owned by AlphaPing or its licensors and are protected by intellectual property laws. Subject to these Terms, AlphaPing grants you a limited, non-exclusive, non-transferable, revocable license to use the Interface for its intended purpose.
No Bug Bounty; No Entitlement to Rewards
AlphaPing does not operate a bug bounty, reward, compensation, or reimbursement program unless explicitly stated in writing. The absence of an explicitly declared program means no entitlement to bounties, rewards, or compensation exists.
Changes to the Interface or Terms
AlphaPing may modify or discontinue the Interface at any time, and may update these Terms from time to time. Continued use of the Interface after changes become effective constitutes acceptance of the updated Terms.
Governing Law; Venue
These Terms are governed by the laws of Switzerland, without regard to conflict of laws principles. To the extent permitted by applicable law, the competent courts of Zug, Switzerland shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Interface.
